Acceptable Use Policy

This policy outlines acceptable and prohibited uses of Namence's services to ensure a safe, secure, and productive environment for all customers.

1. Introduction

This Acceptable Use Policy ("AUP") governs the use of Namence's web hosting, VPS, domain registration, email, and related services. By using our services, you agree to comply with this policy, which is designed to protect the security, integrity, and reliability of our network and ensure a positive experience for all customers.

This policy applies to all customers, users, and any other parties who access or use Namence's services ("Users"). Violation of this policy may result in suspension or termination of your service without refund.

2. General Conduct

Users of Namence services must:

  • Comply with all applicable local, state, national, and international laws and regulations
  • Respect the legal rights of others, including privacy and intellectual property rights
  • Use the services only for lawful purposes and in accordance with this AUP
  • Cooperate with Namence's reasonable investigation of suspected violations of this policy
  • Maintain accurate and up-to-date contact information with Namence

3. Prohibited Activities

The following activities are strictly prohibited when using Namence services:

3.1 Illegal or Harmful Content

  • Hosting, storing, or transmitting content that is illegal, threatening, abusive, or promotes illegal activities
  • Child exploitation material or content promoting harm to minors
  • Content promoting discrimination, bigotry, racism, hatred, or physical harm against any group or individual
  • Content that is defamatory, harassing, invasive of privacy, or otherwise objectionable
  • Content related to illegal drugs, illegal gambling, or counterfeit products
  • Content promoting terrorist activities or violent extremism

3.2 System and Network Security Violations

  • Unauthorized access to servers, networks, or accounts
  • Interference with service to any user, host, or network including denial of service attacks
  • Introducing malicious software such as viruses, worms, or Trojan horses
  • Scanning network addresses without permission from the network owner
  • Intentionally causing degradation of network performance
  • Attempting to circumvent user authentication or security of any host, network, or account

3.3 Email and Communication Activities

  • Sending unsolicited bulk email (spam)
  • Harvesting email addresses for the purpose of sending spam
  • Operating an email service that allows sending spam
  • Forging email headers or other identifying information
  • Sending large volumes of identical or substantially similar messages
  • Email bombing (sending an excessive number of emails to a recipient)

3.4 Resource Usage

  • Using excessive amounts of system resources that interfere with normal operations
  • Running applications or services that consume excessive bandwidth, CPU, or memory
  • Running publicly accessible BitTorrent trackers on shared hosting accounts
  • Using shared hosting as a storage or backup repository unrelated to website hosting
  • Using VPS services for purposes that generate excessive network traffic

3.5 Intellectual Property Violations

  • Copyright infringement, including unauthorized distribution of copyrighted material
  • Hosting or linking to tools designed primarily for copyright infringement
  • Trademark infringement or deceptive use of trademarks
  • Patent violations or misappropriation of trade secrets
  • Willful distribution of counterfeit products or services

  • Personal websites and blogs
  • Business websites and e-commerce
  • Educational content and resources
  • Community forums with proper moderation
  • Software development and testing
  • Email for personal or business communication
  • Legal file storage related to website content
Examples of Prohibited Use
  • Pirated software or media distribution
  • Phishing websites or email campaigns
  • Hacking tools or tutorials
  • Spam generation or distribution
  • Anonymous proxies or VPN exit nodes
  • Cryptocurrency mining operations
  • File hosting services or backup repositories

4. Domain Registration and Use

When registering or managing domains through Namence, users must:

  • Provide accurate and complete WHOIS information
  • Respond to inquiries regarding domain registration information
  • Avoid registering domains solely for the purpose of selling, trading, or leasing
  • Not use domain names for illegal purposes or to promote illegal activities
  • Not infringe on others' trademark or intellectual property rights
  • Comply with ICANN policies and procedures

5. Email Services

Users of Namence email services must:

  • Configure mail servers to accept mail only for their own domains
  • Secure mail servers to prevent unauthorized relaying
  • Implement measures to prevent email address spoofing
  • Send commercial emails only to recipients who have opted in
  • Include a valid unsubscribe mechanism in all commercial emails
  • Honor unsubscribe requests promptly
  • Not use Namence mail servers to send unsolicited bulk emails

6. Reporting Violations

If you become aware of a violation of this Acceptable Use Policy, please report it to Namence by:

  • Your contact information
  • The nature of the violation
  • The specific content, activity, or resource that violates the policy
  • When and where the violation occurred
  • Any other relevant information

7. Enforcement and Penalties

Namence reserves the right to investigate suspected violations of this policy. When we become aware of a possible violation, we may initiate an investigation and take actions including but not limited to:

  • Issuing a warning to the user
  • Temporarily suspending services
  • Permanently terminating services
  • Removing or disabling access to content that violates this policy
  • Reporting the violation to appropriate law enforcement agencies
  • Pursuing legal action against persistent or severe violators
  • Charging the user for administrative costs and/or reactivation charges

8. Policy Updates

This Acceptable Use Policy may be revised from time to time at the sole discretion of Namence. The most current version will always be posted on our website. By continuing to use our services after any revisions take effect, you agree to be bound by the revised policy.
