DMCA Policy
This policy outlines our compliance with the Digital Millennium Copyright Act (DMCA) and the procedure for reporting copyright infringement.
1. Introduction
Namence respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement that are reported to our designated copyright agent identified below.
This policy outlines the procedure for reporting copyright infringement, our response process, and the consequences for users who repeatedly infringe copyright.
2. Reporting Copyright Infringement
If you believe that material or content residing on or accessible through our services infringes your copyright, please send a notice of copyright infringement containing the following information to our designated copyright agent:
- Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by your notification, you may provide a representative list of such works.
- Identification of the material that is claimed to be infringing: Provide the information reasonably sufficient to locate the material, such as the exact URL where it appears, or a detailed description of where the alleged infringing material is located.
- Your contact information: Provide your address, telephone number, and email address so that we can contact you.
- Statement regarding your good faith belief: Include a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Statement regarding the accuracy of your notice: Include a statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of the copyright.
- Your physical or electronic signature: The notice must be signed (physically or electronically) by the copyright owner or a person authorized to act on their behalf.

Upon receipt of a valid DMCA notification, we will take the following steps:
- Acknowledge receipt of your complaint within 1-2 business days.
- Remove or disable access to the material that is claimed to be infringing.
- Take reasonable steps to promptly notify the user that we have removed or disabled access to the material.
- Provide the user with information about how to submit a counter-notification.
4. Counter-Notification Procedure
If you believe that your content was wrongly removed or disabled as a result of a DMCA notification, you may submit a counter-notification. A valid counter-notification must contain the following information:
- Your physical or electronic signature
- Identification of the material that has been removed or to which access has been disabled, and the location where the material appeared before it was removed or access to it was disabled
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Namence may be found, and that you will accept service of process from the person who provided the original notification or an agent of such person

Upon receipt of a valid counter-notification, we will promptly forward it to the person who submitted the original DMCA notification. If we do not receive notice within 10 business days that the original reporter is seeking a court order to prevent further infringement of the material at issue, we will replace or cease disabling access to the material that was removed.
5. Repeat Infringer Policy
In accordance with the DMCA, Namence has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. We may also limit access to our services and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
6. Misrepresentations
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability. If you are unsure whether the material you are reporting is actually infringing, you may wish to contact an attorney before filing a notification.
7. Changes to This Policy
Namence reserves the right to modify this DMCA Policy at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes to this policy constitutes your acceptance of such changes.
